Terms and conditions

Entire contract agreement: This contract or terms and conditions will contain the understanding between the (Photographer) and (Client). This agreement will supersede any and all prior agreements between both parties, the only way to add anything to this agreement will have to be in writing and signed by all parties. if all parties wish to waive any provision in the packages, then the party whom the waiver is sought to be effective must have a signed waiver in writing.

Non-refundable fee: The photography fee is a fee to which the parties who want the photographer for services must pay a non-refundable fee of 25% of the total cost. the 25% fee will be agreed upon at the time of the signed agreement. the remaining 75% shall be paid the day of or day prior to the event. any additional add Ons or products the (Client) wishes to add onto the packages will be added on to the original base pay unless want separate from the base pay of the package. The (Photographer) and (Client) must agree and communicate about the extra services being bought upon signing. everything the (Photographer) and (Client) agree upon will be gone over by both parties at least a week prior to the services in writing.

Cancellation policy: it is the (Client’s) responsibility to notify the (photographer) at least a one week before the event that they’re cancelling. the (Photographer) also reserves the right to retain the deposit of 25% regardless if the (Client) notifies and cancels one week prior to the event.

Copyright and Reproductions: NG.Photography owns all rights on all images created and taken and shall have exclusive rights to all images. the (photographer) has all rights to use the photos taken for the (photographers) portfolio, samples, self-promotion, editorial use, and social media engagement. The (Client) shall not edit or alter the images in anyway as it is deemed unlawful in the state of California, this includes any social media, websites, or third-party software. violation of the agreement may include civil penalties and a breach of contract.

Liability: NG.Photography is not responsible for any injuries inflicted upon any participating parties. the (Client) will be responsible for themselves and their participating members and will release the (photographer) and anyone associated from any claims against their person or their business. The (Client) will assume all possible risks within the activity for this event, including risks that may arise from negligence or carelessness on the part of the persons or entities released from dangerous, defective equipment, or property owned. NG.Photography is also not responsible for loss or stolen items during the event that is taken place. NG.Photography is also not responsible for damage, loss, or stolen items if items are being shipped to the (Client).

Delivery, services, scope of work: NG.Photography will deliver proof of images within a two-week period after the event has finished. the products that are included within the packages will be mailed to the (Client) unless both parties prefer to meet up for the products to be distributed to the (Client). If the products are mailed NG.Photography is not responsible for the damage or stolen items within what was mailed. At the time of signing for this agreement the entirety of the scope of work will be talked over and gone through so both parties can get an understanding of what will be provided.
